PRESIDENT Ferdinand Marcos Jr. is expected to grant clemency to “close to 1,000” individuals deprived of liberty (PDLs) during the upcoming Christmas holidays, as announced by the Department of Justice (DoJ) on Friday.
In a briefing held at the Palace, DoJ spokesman Jose Dominic Clavano 4th explained that the recommendation for clemency is part of the agency’s ongoing efforts to address prison congestion.
“This is an annual occurrence. The Justice Secretary carries out this act on the President’s birthday and on Christmas Day. We provide a list to the Parole and Probation Administration (PPA), and eventually, it is forwarded to the Executive Secretary,” Clavano stated.
While Clavano was uncertain about the exact number of recipients this year, he mentioned that last year’s figure was close to 1,000, and they anticipate a similar number this year.
The amnesty program primarily targets specific groups, such as the elderly and persons with disabilities, who are eligible for pardon.
“There is no priority list; it solely depends on whether they meet the qualifications or not. So, as long as an individual is eligible for pardon, parole, or probation, they will be included in the list,” Clavano clarified.
He further added, “The determination is based on factors such as age, disability, or severe illness. Keeping them detained would lack humanitarianism, especially if they are already elderly.”
However, it is important to note that the pardon does not cover sex offenders, regardless of age.
Clavano also mentioned another initiative aimed at reducing court backlogs by implementing rules on custodial hearings and bail requirements.
He highlighted the National Justice Information System as a crucial tool in the digitalization efforts, which enhances the effectiveness and efficiency of courts in resolving cases.
“This is a program led by the Supreme Court. They will be introducing rules on custodial hearings and bail requirements, which will contribute to reducing jail congestion,” Clavano explained.
By streamlining the legal processes and adopting digital solutions, the justice system aims to expedite the resolution of cases and alleviate the burden on correctional facilities.
Overall, the pardon initiative by President Marcos Jr. reflects the government’s commitment to addressing prison congestion and ensuring that individuals who meet the criteria for clemency are given a chance to reintegrate into society.
While the focus is on providing relief to the elderly and persons with disabilities, it is crucial to maintain a balance between compassion and public safety by excluding sex offenders from the amnesty program.
