After receiving a number of complaints regarding senior citizen discounts, the Department of Trade and Industry (DTI) has clarified its mandate in providing special discounts on basic necessities and prime commodities (BNPCs). This clarification is important to ensure that both businesses and senior citizens understand their rights and responsibilities.
Trade Assistant Secretary for Consumer Protection Group, Amanda Nograles, addressed the issue by stating that the DTI’s primary mandate is to oversee the selling of BNPCs and the implementation of a 5 percent special discount for senior citizens. However, the department no longer covers complaints related to the 20 percent discount and the 12 percent Value Added Tax (VAT) exemption, as these fall under the jurisdiction of the Office of the Senior Citizens Affairs (OSCA) and the National Commission of Senior Citizens (NCSC).
Nograles emphasized that it is crucial for senior citizens and establishments to be aware of the respective roles of the DTI, OSCA, and NCSC. The DTI’s focus is on the 5 percent special discount for BNPCs, while the OSCA and NCSC handle the 20 percent discount and VAT exemption in other establishments such as drug stores.
It is important to note that if an item is already under a promotional discount, senior citizens cannot avail of a “double discount” under the Republic Act 9994, also known as the “Expanded Senior Citizen Act of 2010.” Section 4 of the act clearly states that senior citizens can choose to avail either the promotional discount or the discount provided by the act, whichever is higher.
