Call to Simplify Withdrawal Process for People’s Initiative to Amend Constitution

MANILA, Philippines: Senate Majority Leader Emmanuel “Joel” Villanueva and Sen. Maria Imelda “Imee” Marcos have recently called on the Commission on Elections (Comelec) to ensure that the process of withdrawing signatures from the People’s Initiative (PI) for the amendment of the 1987 Constitution is not burdensome for the people.

Responding to the Comelec’s approval of a “withdrawal form,” Villanueva expressed concern over the complicated requirements involved. He emphasized the importance of making it easy for citizens to exercise their right to withdraw their signatures, just as the process of signing itself is simple. Villanueva stated, “While we appreciate the actions taken by the Comelec regarding the ‘fake’ People’s Initiative (PI), we urge them not to make it difficult for our fellow countrymen to retract their signatures.”

It is worth noting that the Supreme Court has previously ruled that there is no existing law for a People’s Initiative in amending the Constitution. In light of this, Villanueva emphasized the need for clear guidance from the Comelec on this matter.

Senator Marcos, the Chairman of the Senate Committee on Electoral Reforms and People’s Participation, echoed Villanueva’s sentiments and emphasized that the withdrawal of signatures should be as straightforward as affixing them in the first place. Marcos questioned the requirement for individuals to provide an explanation when withdrawing their signatures, stating, “People were not asked for an explanation when they signed the PI sheets, so why should they be asked to explain themselves when they decide to retract their signatures?”

While the Comelec has suspended Resolution 10650 and any actions related to the PI campaign, Marcos expressed hope that the commission would treat the PI sheets in the same manner as the withdrawal sheets, for record purposes only.

In response to these concerns, the Comelec recently approved a “withdrawal form” for individuals who wish to retract their signatures for the amendment of the Charter. However, it is crucial that the process remains accessible and uncomplicated for the people.
