(UPDATE) Former Quezon City mayor Herbert Bautista has pleaded not guilty to the graft charge he is facing before the Sandiganbayan’s Third Division. The charge alleges that Bautista, in conspiracy with former city administrator Aldrin Cuña, caused undue injury to the government in the amount of P25.3 million.
Bautista was arraigned on Monday, following Cuña’s earlier arraignment this month where he also pleaded not guilty.
The Office of the Ombudsman, in the charge sheet, alleges that on or around June 27, 2019, Bautista and Cuña conspired to cause undue injury to the government and conferred unwarranted benefits and advantage on Cygnet Energy and Power Asia, Inc. (Cygnet). This was allegedly done by facilitating and approving the release of public funds as full payment for the implementation of a project, specifically the Supply and Installation of Solar Power System and Waterproofing Works for Civic Center Building F.
Additionally, the Ombudsman claims that Cuña issued an undated certificate of acceptance, while Bautista signed Box C of a disbursement voucher (DV) dated June 27, 2019.
The anti-graft body argues that Cygnet was not entitled to the amount because it had failed to apply for and secure a Net Metering System from Meralco.
In a resolution dated June 7, 2023, the court denied Bautista’s motion to quash the charge. In his motion, Bautista stated that his signature on the DV and approval of the payment to Cygnet did not automatically imply that he had favored the company over others.
The court ruled that the test was whether the crime had been sufficiently described to appraise the accused of the offense charged, and found the charge sheet to be adequate.
On July 25, 2023, the court also denied Cuña’s motion to quash.
