Ratification of the Magna Carta of Filipino Seafarers

The Senate and the House of Representatives have ratified the bicameral conference committee report on the Magna Carta of Filipino Seafarers, marking a significant milestone in the protection and promotion of the interests of seafarers in the Philippines. The report successfully reconciled the provisions of Senate Bill (SB) 2221 and House Bill (HB) 7325.

Sen. Rafael “Raffy” Tulfo, the principal sponsor and one of the authors of SB 2221, expressed his gratitude for the collaborative effort between both chambers in crafting a comprehensive law that safeguards the rights and welfare of Filipino seafarers. He emphasized the importance of this legislation in providing a beacon of support for seafarers during their voyages.

The Magna Carta of Filipino Seafarers addresses various key concerns, including the provision of annual leave. After extensive discussions, the bicam members agreed to a compromise of 3.5 days of leave per month of employment. This provision recognizes the need for seafarers to have sufficient rest and recreation, ensuring their well-being while onboard.

Another significant provision adopted by the Senate is the institutionalization of shipboard training, which will be regulated and monitored by the Maritime Industry Authority (Marina). This measure aims to enhance the credentials of Filipino seafarers and ensure their compliance with the Standards of Training, Certification, and Watchkeeping (STCW).

One crucial aspect that the bicameral committee addressed is the Execution of Judgment and Monetary Awards. In case of a reversal on appeal, the winning party will be guaranteed restitution of the disputed monetary award. This provision seeks to provide a fair and just resolution for seafarers involved in legal disputes.

Sen. Tulfo assured that the Magna Carta of Filipino Seafarers is not the final law the Senate will work on to protect seafarers. He acknowledged concerns raised regarding the efficacy of the Seafarer’s Protection Act and promised to initiate its review in the coming year. This commitment reflects the continuous effort to enhance the legal framework that safeguards the rights and welfare of seafarers.

Kabayan Party-list Rep. Ron Salo, who headed the House panel, commended the ratification of the Magna Carta of Filipino Seafarers, describing it as an early Christmas gift for seafarers and their families. He emphasized that this legislation offers comprehensive protection and upholds the rights of Filipino seafarers, ensuring their well-being and safety.

Rep. Salo highlighted the significance of the Magna Carta as the guiding document for seafarers, institutionalizing crucial safeguards for their rights, including safe and favorable working conditions. This legislation recognizes the invaluable contributions of seafarers to the maritime industry and the Philippine economy, emphasizing the provision of essential support, welfare, and protection.

The bicameral committee responsible for reconciling the provisions of the Magna Carta of Filipino Seafarers included Sen. Tulfo, Rep. Salo, Party-list Representatives Marissa “Del Mar” Magsino (OFW) and Sandro Gonzalez (Marino), Zamboanga City 1st District Rep. Khymer Olaso, Pangasinan 6th District Rep. Marlyn Primicias-Agabas, and Senators Francis “Chiz” Escudero, Maria Imelda Josefa “Imee” Marcos, Emmanuel Joel Villanueva, and Ana Theresia “Risa” Hontiveros.

Rep. Salo expressed his gratitude to Speaker Ferdinand Martin Romualdez for his unwavering support in ensuring that crucial provisions for the rights and welfare of seafarers, as well as measures to enhance their competitiveness, were included in the final bill.

The ratification of the Magna Carta of Filipino Seafarers signifies a significant step forward in the protection and promotion of the rights and welfare of seafarers in the Philippines.
